INFORMATION ABOUT MINOR ATHLETES

The Platform allows participation by minor athletes.

Athlete profiles belonging to individuals under eighteen (18) years of age are private by default.

Profiles relating to children under thirteen (13) years of age shall be created, managed, controlled, and administered exclusively by a parent or legal guardian.

Profiles relating to athletes between thirteen (13) and seventeen (17) years of age may be managed by the athlete, a parent, legal guardian, or another authorized account administrator, subject to applicable law and Platform policies.

The Company does not knowingly permit children under thirteen (13) years of age to independently create accounts, provide parental consent, manage profiles, or submit personal information without parental involvement.

The Company may retain certain tournament results, rankings, awards, achievements, statistical compilations, and historical sports records relating to minor athletes when necessary to preserve historical accuracy, competition integrity, archival value, legal compliance, or legitimate business interests, even if certain personal information is later restricted, removed, or anonymized.

ACCURACY OF SPORTS INFORMATION

Sports information displayed on the Platform may be provided by athletes, parents, legal guardians, coaches, tournament administrators, leagues, authorized scorekeepers, or other third parties.

IM Sportshistory LLC does not independently verify every statistic, result, ranking, record, or item of sports information published on the Platform.

Accordingly, the Company makes no representation or warranty regarding the accuracy, completeness, timeliness, authenticity, or reliability of all information displayed on the Platform.

Users acknowledge that errors, omissions, disputes, duplications, subjective interpretations, or subsequent corrections may exist.

The publication of statistics, results, rankings, recognitions, or historical records on the Platform does not constitute certification, validation, official approval, auditing, endorsement, or independent verification by IM Sportshistory LLC.

The Company reserves the right, but not the obligation, to investigate, annotate, correct, consolidate, archive, restrict, maintain, or remove sports information when reasonably necessary to preserve data integrity, historical accuracy, competition integrity, legal compliance, or legitimate business interests.

PROCESSING OF MINOR PHOTOGRAPHS

Photographs of minor athletes may only be uploaded to the Platform by:

• The parent or legal guardian responsible for the profile
• An administrator authorized by the parent or legal guardian
• An athlete or account holder legally authorized to manage the profile under applicable law and Platform policies

The Company may retain archived copies of photographs where reasonably necessary for legal compliance, dispute resolution, security purposes, enforcement of Platform policies, protection of rights, or preservation of historical sports records.

The Company does not require photographs to be uploaded and reserves the right to restrict, remove, or replace photographs when a reasonable claim involving privacy, identity, image rights, minor safety, or violation of this Policy is received.

Published photographs shall be used exclusively for sports, historical, statistical, informational, and identification purposes within the Platform.

IM Sportshistory LLC acts solely as a technology provider for the storage and display of photographs uploaded by authorized users. The Company does not participate in the capture, production, editing, consent collection, or ownership determination of images uploaded by third parties.

PHOTO-RELATED COMPLAINTS

Any person who believes that a photograph published on the Platform violates privacy rights, image rights, intellectual property rights, parental consent requirements, or any other legitimate right may submit a complaint to: privacy@imsportshistory.com

The Company may temporarily restrict access to the content while conducting a reasonable review.

Following review, the Company may remove, restrict, replace, maintain, archive, annotate, or otherwise manage the disputed content in its sole discretion and in accordance with applicable law, Platform policies, and legitimate business interests.

CHILDREN UNDER 13 (COPPA)

The Company does not knowingly permit children under thirteen (13) years of age to independently create accounts, provide consent, submit personal information, manage profiles, or otherwise interact with the Platform without parental involvement.

Children under thirteen (13) years of age may participate only through profiles managed by a parent or legal guardian.

Before collecting personal information from a child under thirteen (13), the Company may require verifiable parental consent.

LEGAL BASIS FOR DATA PROCESSING

The private profile status does not imply the deletion or invisibility of tournament results, aggregated statistics, historical rankings, championships, recognitions, or historical sports records whose preservation is necessary to preserve historical accuracy, competitive integrity, archival value, or legitimate interests of the Platform.

Adult user profiles may be made public when such functionality becomes available and the user elects to do so.

ADVERTISING AND SPONSORS

The Platform may display:

• Advertisements
• Sponsorships
• Business directories
• Promotional content

related to sports activities.

The Company does not sell personal information to third parties.

The presence of advertisements, sponsors, business listings, promotional materials, or sponsored content does not constitute endorsement, recommendation, certification, approval, partnership, or guarantee by IM Sportshistory LLC.

Advertisers and sponsors do not receive access to private account information unless expressly authorized by the user, required by applicable law, or described in this Policy.

ADDITIONAL PROTECTION OF MINORS' DATA

IM Sportshistory LLC does not sell personal information of minors.

The Company also does not share minors' personal information for behavioral advertising, individualized commercial profiling, data monetization, or other commercial exploitation purposes.

Advertising displayed on the Platform may be contextual or general and does not require the sale of minors' personal information.

The Company adopts reasonable measures intended to minimize the collection, use, and disclosure of personal information of minors to that which is strictly necessary for the operation of the Platform, the management of sports activities, and the preservation of historical sports records.

NO COMMERCIAL PROFILING OF MINORS

The Company does not engage in individualized commercial profiling of minors for behavioral advertising, data monetization, or automated decision-making based solely on minors' personal information.

The foregoing does not limit the use of sports information for the generation of statistics, rankings, tournament results, historical records, sports recognitions, statistical compilations, or features inherent to the Platform.

The Company may change providers when necessary for Platform operations.

The Platform's technology infrastructure may be modified from time to time for operational, security, scalability, availability, or business continuity purposes. Migration of information to new technology providers shall not constitute a transfer incompatible with the purposes described in this Privacy Policy.

Service providers may have access to information solely to the extent reasonably necessary to perform services on behalf of the Company and are not authorized to use such information for their own independent purposes.

COOKIES AND SIMILAR TECHNOLOGIES

The Platform may use essential cookies necessary for:

The Platform does not currently use Google Analytics or Meta Pixel.

Users may configure their browser settings to reject or limit cookies, although certain Platform features may not function properly as a result.

While the Company implements reasonable administrative, technical, physical, and organizational safeguards designed to protect information, no method of transmission over the Internet, electronic storage system, or security procedure can be guaranteed to be completely secure.

Accordingly, IM Sportshistory LLC cannot and does not guarantee absolute security, and users assume the inherent risks associated with electronic communications and online services.

SECURITY MEASURES

The Company implements reasonable administrative, technical, physical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, misuse, destruction, or other unlawful processing.

Although the Company may review, moderate, or remove content when appropriate, it is under no obligation to continuously monitor all content published by users.

The Company does not guarantee immediate detection of offensive, unlawful, infringing, inaccurate, or inappropriate content.

RETENTION OF SECURITY RECORDS

To protect the Platform, prevent unauthorized access, investigate security incidents, and comply with legal obligations, the Company may retain technical and security logs, including:

One of the essential purposes of the Platform is preserving sports history.

Accordingly, even after account deletion, the Company may retain, archive, preserve, consolidate, correct, annotate, or maintain:

• Records
• Statistics
• Achievements
• Championships
• Awards

when necessary to preserve historical and competitive integrity.

SPORTS DECISIONS AND HISTORICAL RECORDS

The preservation of statistics, results, rankings, records, awards, championships, participation history, and other historical records constitutes a fundamental and legitimate purpose of IM Sportshistory LLC.

The Platform is intended to document, organize, and preserve sports information for historical, statistical, informational, and community-reference purposes.

Accordingly, disputes, disagreements, claims, changes of opinion, conflicts among athletes, parents, legal guardians, coaches, teams, leagues, tournament organizers, or other third parties, as well as account deletion, revocation of consent, or subsequent requests for modification or removal of information, shall not necessarily require the Company to remove, alter, conceal, or modify legitimately preserved historical records.

The Company may maintain, correct, consolidate, annotate, update, restrict, or preserve statistics, results, rankings, championships, awards, and historical records whenever it reasonably determines such actions are necessary to protect the historical, competitive, statistical, archival, or documentary integrity of the Platform.

Final decisions regarding preservation, correction, modification, restriction, or removal of statistics, rankings, results, athlete profiles, and historical records shall be made by IM Sportshistory LLC in good faith, taking into consideration available evidence, competition integrity, historical accuracy, applicable legal obligations, and the legitimate interests of the Platform.

The submission of a complaint or dispute does not guarantee the requested modification, deletion, or correction.

Nothing contained in this Policy shall be interpreted as creating a right to require the deletion, alteration, suppression, or modification of legitimately preserved historical sports records where retention is permitted by applicable law.

ACCOUNT DELETION

Users may request deletion of their accounts by contacting the Company.

Information eligible for deletion shall be deleted, anonymized, or restricted as required by applicable law.

Notwithstanding account deletion, the Company may retain information as necessary to:

• Preserve sports history;
• Maintain historical records;
• Comply with legal obligations;
• Resolve disputes;
• Protect Platform security;
• Prevent fraud;
• Exercise legal rights;
• Preserve evidence.

Retention shall be limited to information reasonably necessary for such purposes.

PARENTAL RIGHTS

Parents or guardians may request:

When personal information belongs to a minor athlete, parents or legal guardians may exercise the rights granted to them by applicable law on behalf of the minor.

Subject to applicable legal requirements and reasonable identity verification, parents or guardians may:

• Request the update of information;
• Revoke previously granted consents when legally permissible;

RIGHTS OF USERS IN MEXICO (ARCO RIGHTS)

Data subjects located in Mexico may exercise their rights of Access, Rectification, Cancellation, and Opposition (ARCO Rights) in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares) and other applicable provisions.

Where applicable, ARCO requests must contain:

The Platform does not guarantee athletic advancement, scholarships, recruitment opportunities, sponsorships, or professional contracts.

The Platform acts solely as a technology provider and not as a sports governing body or official sports authority.

ELIGIBILITY

MINOR ATHLETE ACCOUNTS

Athletes under eighteen (18) years old may maintain individual accounts in their own name. Such accounts remain subject to parental supervision and consent.

Parents and legal guardians acknowledge that the Platform is designed to preserve athletic history and public sports statistics related to athletic activities.

Minor athlete accounts may include:

• First name
• Nickname
• Profile photograph
• Team affiliation
• Athletic position
• Age
• State or regional affiliation
• Sports statistics
• Historical athletic records

The Platform shall not publicly display:

• Home address
• Personal telephone number
• Personal email address
• Government identification numbers
• Real-time location information

PARENTAL CONSENT

Prior to activating a minor account, the parent or legal guardian must provide consent.

By granting consent, the parent or legal guardian acknowledges and authorizes:

• The creation of the athlete profile;
• Publication of athletic statistics;
• Publication of authorized profile information;
• Participation in rankings and historical records;
• Storage and processing of data as described in the Privacy Policy.

Upon verification, the Company may deactivate the account and remove information where legally required.

Historical tournament records, rankings, statistics, awards, achievements, and sports history information may be retained where necessary to preserve competition integrity, historical accuracy, archival purposes, legal compliance, dispute resolution, fraud prevention, or legitimate business interests.

CHILDREN UNDER THIRTEEN (13) YEARS OF AGE

The Platform may include athlete profiles for children under thirteen (13) years of age.

Accounts and profiles relating to children under thirteen (13) years of age shall be created, managed, controlled, and administered exclusively by a parent or legal guardian.

The Company does not knowingly permit children under thirteen (13) years of age to independently create accounts, provide parental consent, manage profiles, or submit information directly without parental involvement.

Parents or legal guardians are responsible for all information submitted on behalf of children under thirteen (13) years of age.

All athlete profiles belonging to individuals under eighteen (18) years of age shall be private by default. Public visibility of such profiles is not permitted unless expressly authorized by the Company and permitted under applicable law.

USER ACCOUNTS

Users are responsible for:

• Maintaining password confidentiality;
• Providing accurate information;
• Keeping account information updated;
• Complying with these Terms.

Only one account may be maintained per email address unless expressly authorized.

The Company may suspend, restrict, or terminate accounts that violate these Terms.

Users represent and warrant that all information submitted to the Platform is truthful, accurate, current, and not misleading.

The Company does not guarantee that the Platform will remain available indefinitely and may suspend or discontinue services at any time without liability.

ATHLETIC STATISTICS AND RECORDS

The Platform may collect, receive, organize, display, archive, analyze, and preserve athletic-related information, including:

• Individual statistics
• Team statistics
• Tournament results
• Historical rankings
• Awards
• Records
• Athletic achievements
• Historical sports information

Statistics, records, and related data may be submitted or provided by users and third parties, including athletes, parents, legal guardians, coaches, tournament administrators, scorekeepers, and league operators.

The Company reserves the right, at its sole discretion, to verify, review, annotate, correct, consolidate, modify, recalculate, archive, restrict, or remove any statistics, rankings, records, or historical information where inaccuracies, inconsistencies, duplications, disputes, omissions, or integrity concerns are identified or reasonably suspected.

The Company does not independently verify all submissions and makes no representation or warranty regarding the completeness, accuracy, reliability, authenticity, legality, or timeliness of any information submitted to or displayed on the Platform.

Users acknowledge and agree that sports-related data may contain errors, omissions, subjective inputs, disputes, duplications, delays, or subsequent corrections, and that such data may be updated or revised over time.

PROFILE, STATISTICS, AND HISTORICAL RECORD DISPUTES

Any athlete, parent, legal guardian, coach, team representative, league operator, tournament administrator, or other affected person who believes that any athlete profile, statistic, ranking, tournament result, historical record, team affiliation, photograph, achievement, award, or other information displayed on the Platform is inaccurate, incomplete, misleading, outdated, unauthorized, improperly attributed, duplicated, or otherwise subject to dispute may submit a written request for review to: legal@imsportshistory.com

The request must include sufficient information to reasonably identify the disputed content, along with any supporting documentation reasonably available.

Upon receipt of a dispute, the Company may, in its sole discretion and without obligation:

• Review the submitted information
• Request additional documentation or clarification
• Consider information provided by relevant third parties
• Annotate or flag disputed records
• Correct or update information where appropriate
• Archive, maintain, or preserve historical information

The Company may, at its discretion, consider information provided by third parties, including tournament organizers, league operators, or data providers, when evaluating disputes. However, the Company is not bound by any external determination.

Submission of a dispute does not guarantee modification, correction, removal, restriction, or resolution in favor of the requesting party.

The Company reserves the right to preserve, archive, and display historical sports records, rankings, and statistical compilations where reasonably necessary to maintain historical accuracy, continuity, integrity, and archival value of sports data and records.

Unless otherwise required by applicable law, the Company’s determination regarding disputed information shall be final and binding within the Platform’s internal processes, subject to applicable law.

The Company does not act as an official referee for sports competitions nor as a certifying sports authority.

SPORTS RECORDS ADMINISTRATION AND HISTORICAL PRESERVATION AUTHORITY

IM Sportshistory LLC shall have sole and exclusive discretion to collect, organize, classify, compile, verify, annotate, consolidate, present, publish, archive, preserve, maintain, restrict, correct, update, recalculate, or otherwise manage athletic statistics, rankings, tournament results, athlete profiles, awards, achievements, records, and historical sports information displayed on or maintained through the Platform.

The Company may determine the manner in which such information is categorized, displayed, archived, consolidated, corrected, or preserved when reasonably necessary to maintain historical accuracy, competitive integrity, archival value, data consistency, operational efficiency, legal compliance, or the legitimate interests of the Platform.

Nothing contained in the Platform shall be construed as granting any user ownership, editorial control, approval rights, veto authority, or decision-making authority over the Company’s management, presentation, preservation, organization, classification, or maintenance of athletic records, rankings, tournament results, historical archives, or statistical compilations.

The Company reserves the right to maintain historical records, rankings, tournament results, awards, achievements, and statistical information even following account suspension, account deletion, profile modification requests, dispute submissions, or withdrawal of consent where retention is reasonably necessary to preserve the integrity, accuracy, continuity, and historical value of sports records.

RANKINGS DISCLAIMER

Rankings are informational tools intended solely to support athletic participation, organization, and historical recordkeeping.

Rankings:

• Are not official unless expressly designated by the applicable governing body or competition organizer
• May vary based on data sources, availability of information, or updated methodologies
• May contain errors, omissions, delays, or subjective determinations
• Do not constitute athletic certification, official verification, or professional evaluation
• Do not guarantee recruitment opportunities, scholarships, advancement, or athletic outcomes

Rankings displayed on the Platform are generated using available information, which may include user-submitted data, tournament records, and other third-party inputs that may be incomplete or unverified.

Rankings constitute solely statistical and informative tools and do not represent official evaluations, sports certifications, professional opinions, nor recruitment recommendations.

The Platform does not act as a governing sports authority and does not certify athletic performance, competition outcomes, or official standings.

The Company shall not be responsible or liable for any decisions, actions, or omissions made by athletes, parents, coaches, scouts, educational institutions, or any third parties based on rankings or related information displayed on the Platform.

SCHOLARSHIP AND RECRUITMENT DISCLAIMER

The Platform may increase athlete visibility. However, IM Sportshistory LLC does not guarantee:

• Scholarships;
• Recruitment opportunities;
• Collegiate offers;
• Sponsorships;
• Professional contracts;
• Selection to teams or programs.

All recruitment and scholarship decisions remain solely within the discretion of third parties.

Users expressly acknowledge that rankings, athlete visibility, statistics, historical records, tournament participation, achievements, and awards displayed on the Platform do not create any promise, representation, expectation, entitlement, guarantee, or likelihood of athletic recruitment, scholarships, sponsorships, endorsements, roster selection, collegiate opportunities, professional opportunities, or economic benefits.

The Company shall not be liable for decisions, actions, omissions, evaluations, selections, rankings, admissions, scholarships, sponsorships, roster placements, disciplinary actions, or opportunities granted or denied by third parties.

NAME, IMAGE, AND LIKENESS (NIL)

The Platform may display athlete names, nicknames, profile photographs, statistics, and historical athletic records.

Use of athlete names, images, or likenesses for promotional, advertising, or commercial endorsement purposes beyond ordinary Platform operation requires appropriate authorization where required by law.

Editorial, journalistic, statistical, historical, and informational uses may be made consistent with applicable law.

The Company will review complaints in good faith and may take corrective action where appropriate.

USER GENERATED CONTENT

Users may upload photographs, videos, athletic records, statistics, profile information, and other sports-related content.

• They possess all necessary rights, licenses, permissions, and authorizations required to publish such content.

Users are solely responsible for all content they submit to the Platform.

The Company assumes no responsibility for user-submitted content.

Users shall be solely responsible for all content uploaded, published, submitted, transmitted, or otherwise made available through the Platform and shall assume full responsibility for any claims arising from copyright infringement, unauthorized use of photographs, videos, trademarks, NIL rights, privacy rights, publicity rights, or any other intellectual property or personal rights violations.

THIRD-PARTY CONTENT DISCLAIMER

The Platform contains information, statistics, rankings, tournament results, athlete profiles, historical records, photographs, videos, comments, team information, awards, achievements, and other content provided, submitted, uploaded, published, or otherwise made available by users or third parties.

IM Sportshistory LLC does not endorse, adopt, verify, investigate, certify, monitor, guarantee, or assume responsibility for the accuracy, completeness, reliability, authenticity, legality, ownership, timeliness, quality, suitability, or availability of any third-party content.

Users acknowledge that statistics, rankings, tournament results, historical records, athlete profiles, photographs, videos, and other sports-related information may contain errors, omissions, inaccuracies, subjective determinations, disputes, duplications, delays, unauthorized submissions, or subsequent corrections.

Users access, review, interpret, rely upon, and use third-party content entirely at their own risk.

The Platform operates solely as a technology provider and repository of sports-related information and does not act as a governing body, sanctioning authority, recruiting organization, certifying authority, official scorekeeper, official statistician, educational institution, sports federation, league authority, tournament authority, or official source of record unless expressly stated otherwise.

To the fullest extent permitted by applicable law, IM Sportshistory LLC shall not be liable for any loss, damage, injury, reputational harm, emotional distress, economic loss, lost opportunities, decisions, actions, omissions, disputes, claims, or other consequences arising from or related to any third-party content or any reliance placed upon such content.

Nothing contained in third-party content shall be construed as a representation, warranty, certification, endorsement, recommendation, guarantee, or statement of fact by IM Sportshistory LLC.

CONTENT LICENSE GRANTED TO THE COMPANY

Users retain ownership of all photographs, videos, statistics, and other content submitted to the Platform.

By uploading or submitting content, users grant IM Sportshistory LLC a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, transferable, sublicensable license to use such content for the operation, provision, maintenance, improvement, and promotion of the Platform, including the right to create derivative works solely for purposes of operating, maintaining, and improving the Platform:

• Host content
• Store content
• Display content
• Reproduce and distribute content within the Platform
• Organize and structure content
• Archive content
• Create and maintain statistical compilations
• Create and maintain historical sports records and archives
• Preserve and present sports history data
• Use content for marketing and promotional purposes related to the Platform

This license survives account termination or deletion solely to the extent necessary to preserve historical sports records, statistical integrity, rankings, tournament results, achievements, awards, and archival or legal compliance purposes.

The user represents and warrants that they possess all necessary authorizations from athletes, parents, legal guardians, photographers, and other rights holders to grant this license.

PROFESSIONAL PHOTOGRAPHERS

The Company acknowledges and respects the rights of professional photographers and content creators, subject to applicable copyright, privacy, and NIL laws.

Photographers and rights holders may request attribution where reasonably applicable and supported by Platform functionality or display format.

Users may not upload photographs, videos, or other content without having obtained all necessary rights, licenses, permissions, or legal authorization.

The Company reserves the right, upon receipt of a good faith notice or valid complaint alleging copyright infringement, ownership disputes, privacy violations, NIL violations, or other intellectual property concerns, to remove, restrict, or disable access to such content at its sole discretion.

DMCA POLICY

The Company respects intellectual property rights and may remove allegedly infringing content in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws.

Users authorize recurring charges until cancellation.

PAYMENT PROCESSING

Payments are processed by third-party providers including Stripe.

The Company does not store complete payment card information.

By submitting payment information, users agree to comply with applicable payment processor terms. The Company does not control nor guarantee the continuous availability of payment processing services provided by third parties.

The Company shall not be liable for payment processor errors, banking delays, declined transactions, or third-party payment failures.

REFUNDS

Refund requests may be evaluated on a case-by-case basis.

The Company reserves discretion regarding refunds except where prohibited by applicable law.

Users remain responsible for canceling recurring subscriptions before renewal dates.

PROHIBITED CONDUCT

Users may not:

• Upload unlawful content;
• Upload unauthorized photographs;
• Upload unauthorized videos;
• Manipulate statistics;
• Harass athletes;
• Harass minors;
• Create fraudulent accounts;
• Impersonate others;
• Circumvent Platform security;
• Engage in hacking activities;
• Use automated scraping tools;
• Interfere with Platform operations;
• Use bots;
• Reverse engineer the Platform;
• Engage in identity theft;
• Circumvent or evade security measures;
• Engage in unauthorized commercial use.

Violations may result in immediate suspension or termination.

MODERATION

The Company may, at its sole discretion and without prior notice, review, monitor, restrict, suspend, disable, remove, modify, archive, or terminate any content, account, feature, access right, or user activity when deemed necessary to:

• Protect users;
• Protect minors;
• Protect intellectual property rights;
• Preserve Platform integrity;
• Enforce these Terms;
• Comply with applicable laws, regulations, court orders, governmental requests, or legal obligations; or
• Prevent fraud, abuse, security threats, unlawful conduct, or other harmful activities.

The Company has no obligation to monitor all content, communications, activities, statistics, rankings, profiles, photographs, videos, tournament records, or information available through the Platform.

The Company does not guarantee the detection, review, investigation, correction, removal, restriction, prevention, or enforcement against unlawful, offensive, inaccurate, misleading, fraudulent, infringing, harmful, objectionable, or otherwise inappropriate content or conduct.

The exercise or non-exercise of moderation rights shall not create any duty, responsibility, liability, representation, warranty, or expectation that the Company will monitor, review, remove, correct, or prevent any particular content, activity, or user behavior.

MINOR SAFETY PROTECTIONS

Minor accounts shall not have access to direct messaging functionality.

Minor accounts shall not display:

• Personal telephone numbers;
• Personal email addresses;
• Real-time geolocation data.

Parents or legal guardians may request review, correction, restriction, or removal of minor account information.

Parents and legal guardians may exercise applicable privacy rights on behalf of their minor children, subject to applicable law and the Company’s historical record preservation obligations.

SPORTS PARTICIPATION DISCLAIMER

Participation in athletic activities involves inherent risks.

The Platform does not organize, host, supervise, officiate, control, or guarantee any sporting events. The Company operates solely as a technology platform that collects, manages, and displays sports-related information such as results, statistics, rankings, and historical records provided by third parties.

The Company shall not be liable for any sporting activity or event, or for any consequences arising from participation in such activities, including but not limited to:

• Injuries;
• Illnesses;
• Medical expenses;
• Disabilities;
• Death;
• Property damage;
• Emotional distress;

arising from participation in sports activities or sporting events.

Users assume all risks associated with participation in sports activities.

The Company does not organize, manage, sponsor, supervise, or control teams, leagues, tournaments, or competitions, unless expressly stated otherwise in writing.

SPORTS HISTORICAL PRESERVATION

A core purpose of the Platform is the preservation of sports history.

Accordingly, the Company may retain, archive, display, preserve, and reference:

• Tournament results
• Historical rankings
• Records
• Championships
• Awards
• Athletic achievements
• Statistical compilations
• Historical sports information

even after account deletion where necessary to preserve historical accuracy, competition integrity, archival value, legal compliance, or legitimate business interests.

Where appropriate, personally identifiable information may be removed, restricted, or anonymized.

Historical preservation and archival purposes may prevail over individual requests to remove or alter tournament results, rankings, awards, championships, or statistical records where the Company reasonably determines that retention is necessary to preserve the integrity and accuracy of sports history.

The preservation of historical sports records may include statistics, rankings, results, championships, recognitions, achievements, participation, sports affiliations, and other historical information associated with sports competitions.

NO SALE OF PERSONAL INFORMATION

IM Sportshistory LLC does not sell personal information to third parties.

The Company may display advertising, sponsorships, business listings, promotional materials, and sports-related commercial opportunities without selling personal information.

FORCE MAJEURE

The Company shall not be liable for delays, interruptions, failures, or inability to perform caused by events beyond its reasonable control, including natural disasters, cyberattacks, internet outages, telecommunications failures, governmental actions, labor disputes, pandemics, acts of war, civil disturbances, or failures of third-party service providers.

The Company shall likewise not be liable for cyberattacks, unauthorized access, malware, ransomware incidents, distributed denial-of-service attacks (DDoS), security breaches, or other malicious activities conducted by third parties despite the implementation of commercially reasonable security measures.

NO AGENCY OR REPRESENTATION

Nothing contained in the Platform, these Terms, rankings, athlete profiles, statistics, tournament participation, communications, or services shall be construed as creating any agency, employment, partnership, joint venture, fiduciary, recruiting, scouting, representation, advisory, sponsorship, endorsement, or contractual relationship between the Company and any athlete, parent, guardian, coach, team, league, tournament organizer, educational institution, scout, recruiter, sponsor, or third party, including any apparent authority or implied representation.

PLATFORM MODIFICATIONS

The Company reserves the right, at any time and without liability, to modify, suspend, discontinue, replace, redesign, update, restrict, or remove any aspect of the Platform including rankings, methodologies, statistics, tournament management tools, subscription features, pricing, functionality, content, services, or access rights.

ADVERTISING, SPONSORSHIPS, AND PROMOTIONAL CONTENT

The Platform may display advertisements, sponsorships, business listings, promotional campaigns, affiliate content, commercial announcements, tournament promotions, brand partnerships, and other marketing materials provided by third parties.

The appearance of any advertisement, sponsor, business, organization, team, league, product, service, athlete, coach, tournament, educational institution, or commercial opportunity on the Platform does not constitute an endorsement, recommendation, certification, guarantee, representation, or approval by IM Sportshistory LLC.

The Company does not guarantee the accuracy, legality, safety, availability, quality, suitability, reliability, or performance of any products, services, promotions, offers, opportunities, scholarships, events, businesses, sponsors, advertisers, or third parties featured on the Platform.

Any interaction, communication, transaction, agreement, purchase, registration, participation, or relationship between a user and any advertiser, sponsor, or third party is solely between such parties.

IM Sportshistory LLC shall not be responsible or liable for any loss, damage, injury, dispute, claim, misrepresentation, fraud, contractual issue, or other matter arising from a user’s interaction with advertisers, sponsors, promotional partners, or third parties.

Advertisements may be displayed based on general sports-related interests, geographic regions, tournament participation, team affiliations, or other non-sensitive information consistent with the Privacy Policy.

The Company does not sell personal information and does not permit advertisers to access private account information except as expressly disclosed in the Privacy Policy or required by law.

The Company does not act as an agent, broker, representative, or guarantor of any advertiser, sponsor, or third party.

DISCLAIMER OF WARRANTIES

The Platform is provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by applicable law, IM Sportshistory LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation any warranties regarding:

• Continuous availability of the Platform;
• Uninterrupted or error-free operation;
• The accuracy, completeness, reliability, or timeliness of statistics, rankings, records, or other information;
• Correction of defects, errors, or inaccuracies;
• Compatibility with any particular device, operating system, browser, software, or hardware configuration;
• The obtaining of scholarships, recruitment opportunities, sponsorships, athletic advancement, or any sports-related benefits.

Use of the Platform is solely at the user’s own risk.

ELECTRONIC CONSENT AND ELECTRONIC SIGNATURES

Users agree that clicking acceptance buttons, checking boxes, creating accounts, making payments, providing parental consent, or otherwise interacting electronically with the Platform constitutes a valid electronic signature and legally binding agreement under applicable law.

LIMITATION OF LIABILITY

The Company’s maximum aggregate liability arising out of any claim related to the Platform, regardless of the legal theory invoked, shall not exceed the greater of:

• a) the amounts actually paid by the user to the Company during the twelve (12) months prior to the event giving rise to the claim; or
• b) one hundred US dollars (USD $100).

INDEMNIFICATION

The user agrees to defend, indemnify, and hold harmless IM Sportshistory LLC, its parent entities, affiliates, subsidiaries, officers, directors, managers, members, employees, contractors, agents, representatives, licensors, successors, and assigns from and against any and all claims, demands, actions, proceedings, investigations, liabilities, damages, judgments, settlements, losses, fines, penalties, costs, expenses, and reasonable attorneys’ fees arising out of or relating to:

• The user’s access to or use of the Platform;
• Any content, information, statistics, rankings, photographs, videos, athlete profiles, records, comments, submissions, or materials uploaded, published, transmitted, submitted, displayed, or otherwise made available by the user;
• Any alleged or actual infringement, misappropriation, or violation of copyrights, trademarks, rights of publicity, rights of privacy, NIL rights, intellectual property rights, proprietary rights, or other legal rights of any person or entity;
• Unauthorized use, publication, submission, or distribution of photographs, videos, athlete information, personal information, statistics, rankings, tournament results, or historical records;
• Manipulation, falsification, misrepresentation, misuse, alteration, or improper submission of statistics, rankings, records, athlete profiles, tournament information, or sports-related data;
• Violations of these Terms and Conditions, the Privacy Policy, Parental Consent Policy, Intellectual Property Policy, DMCA Policy, or any other Platform policies;
• Violations of any applicable law, regulation, court order, governmental requirement, or third-party right;
• Fraudulent, unlawful, misleading, negligent, harmful, abusive, defamatory, harassing, or otherwise improper conduct by the user; or
• Any dispute between the user and any athlete, parent, legal guardian, coach, team, league, tournament organizer, educational institution, recruiter, sponsor, advertiser, photographer, content creator, or other third party arising from or relating to the Platform.

IM Sportshistory LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the user. In such event, the user agrees to cooperate fully with the Company’s defense of such claim.

The obligations set forth in this Section shall survive account suspension, account termination, account deletion, and the user’s discontinuation of use of the Platform.

ARBITRATION AGREEMENT

Any controversy, claim, or dispute arising out of these Terms or related to the Platform shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable rules.

The arbitration shall take place in California, United States.

The arbitral award shall be final and binding upon the parties and may be enforced in any court of competent jurisdiction.

TIME LIMITATION FOR CLAIMS

Any claim arising out of or relating to the Platform must be filed within one (1) year after the event giving rise to the claim.

Claims filed after such period are permanently barred.

CLASS ACTION WAIVER

Users agree that disputes shall be resolved individually.

Users waive the right to participate in class actions, representative actions, or consolidated proceedings.

GOVERNING LAW

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.

TERMINATION

The Company may suspend or terminate accounts for violations of these Terms.

The Company may also terminate accounts to protect minors, intellectual property rights, community safety, or legal compliance.

SURVIVAL

The provisions relating to intellectual property, content licenses, historical preservation, limitation of liability, indemnification, arbitration, class action waiver, and any other provisions that by their nature should survive termination shall remain in effect after account termination or deletion.

SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is determined by a court or competent authority to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.

I understand that IM Sportshistory LLC acts solely as a technology provider and does not produce, capture, direct, or control the creation of such content.

HISTORICAL RECORDS AND SPORTS PRESERVATION

I acknowledge that one of the essential purposes of the Platform is the preservation of sports history.

Accordingly, statistics, rankings, tournament results, awards, championships, participation records, recognitions, and other historical sports information may be retained even if an account is later deleted or consent is subsequently revoked, when such retention is reasonably necessary to preserve historical accuracy, competitive integrity, archival value, legal compliance, or legitimate interests of the Platform.

PRIVATE MINOR PROFILES

I understand that minor athlete profiles are private by default.

The Platform does not intentionally display publicly:
